German Inheritance Tax: How to Keep Your Exemption Even If You Move Out Early

German Inheritance Tax: How to Keep Your Exemption Even If You Move Out Early
22 Jul 2026

Inheriting a family home in Germany comes with substantial tax advantages. Under German tax law, surviving spouses, registered partners, and children can inherit a family residence completely tax-free. However, the standard rule requires you to live in the home as your primary residence for at least ten years.

If you move out or sell before the ten years are up, the German tax office usually demands full tax payment retroactively.

What happens if severe illness or unforeseen health issues make staying in the home impossible? Recent rulings from the German Federal Finance Court (BFH) bring reassuring news for heirs facing difficult personal circumstances.

The 10-Year Rule for the Family Home Exemption

To qualify for a 100% inheritance tax exemption on a home in Germany, basic conditions must be met:

  • Deceased’s Residence: The deceased must have lived in the property until death (unless moved earlier for compelling reasons such as nursing care).

  • Immediate Occupation: The heir must move in promptly after the inheritance and use the house as their main residence.

  • 10-Year Requirement: The heir must stay in the home for at least ten consecutive years.

  • Size Limit for Children: For children, tax exemption applies up to 200 square meters of living space.

Can You Move Out Early Without Paying Inheritance Tax?

Normally, leaving the property before ten years triggers retroactive tax assessments. However, the German Federal Finance Court ruled in two landmark cases (Judgments II R 1/21 and II R 18/20) that heirs keep their tax exemption if compelling objective reasons prevent them from staying.

The court established that severe health conditions or psychological trauma make continued living in the home unfeasible or unreasonable. In these situation, selling, demolishing, or moving out early will not cancel your tax relief.

What Counts as a Compelling Reason?

The court approved tax relief in two key scenarios:

  1. Physical Health Conditions: An heir suffered severe spinal disk problems and hip ailments combined with anxiety that prevented surgery, making daily life in the house unmanageable.

  2. Psychological Distress: A widow developed severe depression after her husband’s death. Doctors confirmed that continuing to live in their joint home placed her at risk of further mental health damage.

Important Note: Financial convenience or personal preference is not enough. The health obstacle must specifically prevent you from staying in that particular family home.

Essential Steps Before You Move Out or Sell

If health issues prevent you from staying in your inherited German property, avoid moving out or selling abruptly. Take these essential steps to safeguard your tax-free status:

  • Secure Medical Evidence First: Obtain detailed medical certificates or expert psychological assessments before moving out.

  • Document Property Issues: Collect expert reports if physical or structural barriers in the home aggravate your health condition.

  • Notify the Tax Office in Advance: Present your documentation to the German tax authorities before selling or leaving.

  • Get Expert Advice: Work with a tax lawyer or specialist advisor to present your case correctly to the tax authorities.
